Terms for evaluating and using OpsRail Command Center during early demos, pilots, and non-production evaluations.

Early-evaluation document

This page is provided for early evaluation and pilot discussions and should be reviewed by legal counsel before production use. It is not a substitute for a negotiated customer agreement or for advice from a qualified attorney.

Section 01

Acceptance of terms

By accessing or using OpsRail Command Center — including any demo environment, sandbox, evaluation tenant, or pilot deployment — you agree to these Terms and Conditions on behalf of yourself and any organization you represent. If you do not agree, do not access or use the product.

Section 02

Product purpose

OpsRail Command Center is an operational intelligence tool for Medicare Advantage supplemental benefit operations. It is designed to analyze operational files — such as decline reports, eligibility summaries, SKU/UPC mappings, and escalation trackers — to surface potential operational risks and generate evidence-based briefs for operations teams.

Section 03

Evaluation and pilot use

The product is currently intended for demos, evaluations, and pilot use only. You should not rely on the product as the sole source for operational, compliance, financial, or legal decisions. Outputs are intended to support — not replace — qualified human review and existing systems of record.

Section 04

No PHI or sensitive data during MVP

You must not upload any of the following during MVP evaluation unless a separate written agreement is in place:

  • Protected health information (PHI)
  • Direct member identifiers
  • Social Security Numbers (SSNs)
  • Medicare Beneficiary Identifiers (MBIs)
  • Full payment card numbers (PANs)
  • Clinical data or medical diagnoses
  • Other sensitive personal information

Section 05

User responsibilities

You are responsible for:

  • Ensuring you have the right to upload any data you provide.
  • Removing or masking direct identifiers before upload.
  • Reviewing AI-generated outputs before relying on or sharing them.
  • Validating findings against your source systems of record.
  • Complying with your own internal policies and all applicable laws.

Section 06

AI-generated content

The product may use AI to generate summaries, briefs, or suggested communications based on structured incident evidence. AI output may be incomplete or inaccurate and should be reviewed by a qualified user before being shared or acted upon. The deterministic incident records and uploaded evidence remain the source of truth — not the AI-generated narrative.

Section 07

No professional advice

The product does not provide legal, medical, clinical, actuarial, financial, regulatory, or compliance advice. Nothing produced by the product should be interpreted as professional advice or as a substitute for qualified human judgment.

Section 08

Data and system availability

During MVP and pilot use, the service may change, be interrupted, contain bugs, or be discontinued without notice. No uptime, support, or service level guarantee is provided unless covered by a separate written agreement.

Section 09

Intellectual property

The product, software, user interface, workflows, analysis logic, and generated system outputs are owned by the OpsRail Command Center team or its licensors. This is subject to your ownership of the data you upload, as described in the Customer data section.

Section 10

Customer data

You retain ownership of any data you upload. The product may process uploaded data solely to provide the service, generate incidents, and produce briefs during the evaluation or pilot. Additional details on data handling are described in the Privacy Policy.

Section 11

Prohibited uses

You may not use the product to do any of the following:

  • Uploading PHI or direct identifiers without a separate written agreement.
  • Attempting to reverse engineer, probe, or disrupt the service.
  • Using the product for any illegal purpose.
  • Uploading malicious files or content.
  • Misrepresenting AI-generated content as independently verified fact.
  • Using the product to make final member eligibility, benefit, clinical, or legal determinations without human review.

Section 12

Limitation of liability

To the maximum extent permitted by applicable law, the service is provided “as is” and “as available,” without warranties of any kind, express or implied. The OpsRail Command Center team shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the MVP, demo, or pilot environment. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Section 13

Changes to these terms

These terms may be updated as the product evolves. Material changes will be reflected by updating the “Last updated” date at the top of this page. Your continued use of the product after an update constitutes acceptance of the revised terms.
